If you would like to submit a request, please do so electronically using FOIAonline (https://www.foiaonline.gov).  Select the 'Department of the Navy' option, then from the first dropdown select "Marine Corps", and from the second dropdown select the command to which you wish to submit your request (i.e., the command that would maintain the records you are seeking).

If you submitted a request through the U.S. Postal Service and have not received an acknowledgement, this means that we have not received it and will not until we resume normal operations.  Please re-submit your request following the process above.

Introduction

Each federal agency is responsible for meeting its FOIA responsibilities for its own records.  This site is designed to familiarize you with the specific procedures for making a request for records controlled by the U.S. Marine Corps

 

The Freedom of Information Act (FOIA), 5 United States Code (USC) 552, allows an individual (regardless of nationality), a private organization or company, or a local, state, or foreign government to seek access to Executive Branch agency RECORDS, such as those held by the U.S. Marine Corps.

 

All agencies of the U.S. Government are required to disclose records upon receiving a written request, except those records that are protected from disclosure pursuant to nine exemptions and three exclusions.  The FOIA applies only to federal agencies and does not create a right of access to records held by Congress, the courts, or by state or local government agencies.  Any requests for state or local government records should be directed to the appropriate state or local government agency. 

 

As a component of the Department of the Navy, Secretary of the Navy Instruction 5720.42F, Department of the Navy Freedom of Information Act (FOIA) Program (SECNAVINST 5720.42F), governs the Marine Corps FOIA program. SECNAVINST 5720.42F is codified at 32 Code of Federal Regulations (CFR) Part 701.

SUBMIT A PRIVACY ACT REQUEST

Privacy Act requests are requests for your own and/or your minor child's Personal Identifiable Information (PII) ONLY.

Privacy Act requests for PMO and Counseling records.

 

FOIA and PA request requires a FOIA Online account.

1. Create a FOIA Online account at www.FOIAOnline.gov.  Click here for instructions on creating a FOIA/PA account and making a FOIA/PA request online.  **(Please use a personal civilian email ONLY)**

2. After submitting the FOIA or PA request online.  You will receive a FOIA Online case number after submitting your online request (Example: DON-USMC-2019-123456).

 

Privacy Act request :

1. Email the FOIA/PA Official Mail Box at MCBSJAFOIA@usmc.mil with the following information:

If applicable (**Required if known): 

-**FOIA Online case number you received after submitting your online request. (Example: DON-USMC-2019-123456

-**PMO/CID/FAP case number (provided by PMO Records or FAP).

Required:

-If the above is unknown, then provide specific and relevant information describing the nature, time frame, and location of your records. (**Non-specific or detailed info will be difficult to locate and may be returned for specifics and/or denied processing.**)

-Civilian/Personal Email

-Printed Name and Signature statement containing the following "I declare under perjury that the foregoing is true and correct."  Executed on (date). 

2. You will receive an email confirming receipt.

Do not send Personally Identifiable Information to this e-mail address (ie. SSN, DOB, etc.)

**For Privacy Act requests you MUST complete the Steps above.**

 

FOIA request (For records subject to public release):

Submit all FOIA request online.  You will receive a FOIA Online case number after submitting your online request (Example: DON-USMC-2019-123456).
